  • ALERT:
    According to Section 2 of 'The Prevention of Insults to National Honour Act, 1971', whoever in any public place or in any other place within public view:
    • Burns, mutilates, defaces, defiles, disfigures, destroys, tramples upon, or otherwise shows disrespect to the Indian National Flag or the Constitution of India.

    • Brings the Indian National Flag or the Constitution of India into contempt (whether by words, either spoken or written, or by acts).


Such actions are punishable with imprisonment for a term which may extend to three years, or with a fine, or with both.
The Act also includes several explanations to clarify what constitutes disrespect to the Indian National Flag.

This includes:

    • A "gross affront or indignity" to the flag.
      Using the flag as a portion of a costume, uniform, or accessory worn below the waist.
    • Embroidering or printing the flag on cushions, handkerchiefs, napkins, undergarments, or any dress material.
    • Using the flag as a receptacle for carrying anything (with an exception for flower petals on certain occasions).
    • Using the flag as a covering for a statue, monument, speaker's desk, or platform.
    • Intentionally allowing the flag to touch the ground or floor.
    • Intentionally displaying the flag with the "saffron" down.
